Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern access to and use of lendingflow.com and the LendingFlow lead-generation platform ("Service"), operated by LendingFlow ("LendingFlow," "we," "us," or "our"). By creating an account, completing the onboarding questionnaire, or otherwise using the Service, you ("Customer," "you") agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

LendingFlow provides Customers with leads for prospective borrowers based on the loan types, target states, delivery method, delivery pace, and delivery schedule selected during onboarding. Leads are delivered exclusively to the Customer who purchased the corresponding order, via the Customer's chosen CRM integration or email.

3. Accounts and Onboarding

To use the Service, you must complete our onboarding questionnaire and provide accurate, current, and complete information, including your contact details, loan type preferences, target states, and delivery preferences. You are responsible for keeping this information up to date and for all activity under your account.

4. Orders, Fees, and Payment

  • • Lead orders are purchased in advance based on the total number of leads and delivery pace specified during onboarding (e.g., leads per day, not to exceed 20% of the total order).
  • • Fees are due at the time of purchase unless otherwise agreed in writing.
  • • You authorize LendingFlow and its payment processor to charge your payment method for all fees associated with your order.

5. Refund and Credit Policy

All sales are final. LendingFlow does not offer cash refunds for lead orders, whether purchased in full or in part.

If a delivered lead does not meet the criteria specified in your order (e.g., incorrect loan type, incorrect state, or other agreed-upon lead criteria), LendingFlow's sole remedy is to issue account credit or a replacement lead of equivalent value, at LendingFlow's discretion. Requests for credit or replacement must be submitted to info@lendingflow.com within 5 business days of delivery, along with supporting details.

No refunds, credits, or replacements will be issued for leads that meet the specified order criteria, regardless of whether the Customer is able to convert the lead into a closed deal.

6. Customer Responsibilities

You agree to:

  • • Use leads only for legitimate lending and financing purposes
  • • Comply with all applicable laws, including those governing telemarketing, email marketing, and consumer lending (e.g., TCPA, CAN-SPAM, and applicable state lending laws)
  • • Not resell, redistribute, or share leads with third parties without LendingFlow's prior written consent
  • • Not misrepresent your identity or business when contacting Leads

7. Intellectual Property

The Service, including its software, design, and content (excluding Lead and Customer data), is owned by LendingFlow and protected by intellectual property laws. You may not copy, modify, or reverse-engineer any part of the Service except as permitted by law.

8. Disclaimers

THE SERVICE AND ALL LEADS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. LENDINGFLOW DOES NOT GUARANTEE THAT ANY LEAD WILL RESULT IN A CLOSED LOAN OR SALE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LENDINGFLOW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. LENDINGFLOW'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO LENDINGFLOW IN THE 3 MONTHS PRECEDING THE CLAIM.

10. Termination

LendingFlow may suspend or terminate your access to the Service at any time for violation of these Terms. You may cancel future orders at any time, subject to the Refund and Credit Policy in Section 5 for any orders already placed.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute arising out of these Terms will be brought exclusively in the state or federal courts located in Travis County, Texas.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
